Terms of Service

These Terms of Service ("Terms") govern your use of ShinDig (shindig.chat), a live social video platform operated by Andre Martin ("ShinDig," "we," "us," or "our"), based in Florida, USA. By creating an account or using ShinDig in any way, you agree to these Terms. If you do not agree, do not use ShinDig.

1. Eligibility

You must be at least 18 years old to use ShinDig. By creating an account, you represent and warrant that you are 18 or older and that all information you provide is accurate. We reserve the right to terminate accounts where we have reason to believe a user does not meet this requirement.

2. Your Account

• You are responsible for maintaining the security of your account and password
• You are responsible for all activity that occurs under your account
• You may not share your account with others or create accounts on behalf of others
• You may not create more than one account per person unless explicitly permitted by us
• Notify us immediately at shindigsupport@gmail.com if you believe your account has been compromised

3. Acceptable Use

Your use of ShinDig is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. In addition to the restrictions listed there, you agree not to:

• Attempt to gain unauthorized access to ShinDig's systems or other users' accounts
• Scrape, crawl, or collect data from ShinDig using automated tools without our written permission
• Reverse engineer, decompile, or otherwise attempt to extract source code from ShinDig
• Use ShinDig to transmit malware, viruses, or any other harmful code
• Interfere with or disrupt the integrity or performance of ShinDig or its underlying infrastructure
• Resell, sublicense, or commercialize access to ShinDig or any ShinDig feature without our written permission

4. Content You Post

You retain ownership of content you post to ShinDig (photos, bio, messages, etc.). By posting content on ShinDig, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute that content as necessary to operate the platform — for example, displaying your profile photo to other users.

You are solely responsible for the content you post. You represent and warrant that:

• You own or have the right to post the content
• Your content does not violate the rights of any third party, including copyright, privacy, or publicity rights
• Your content complies with these Terms and our Acceptable Use Policy

We reserve the right to remove any content that violates these Terms, without notice.

5. VIP Membership and Payments

• VIP membership is a paid subscription that unlocks enhanced platform features
• Payments are processed by Stripe. By purchasing VIP membership, you also agree to Stripe's Terms of Service
• All purchases are final. We do not offer refunds except where required by applicable law
• We reserve the right to change pricing with reasonable notice
• If your account is terminated for violations of these Terms, you forfeit any remaining membership period without refund

6. Dating Features

ShinDig's dating features (Discover, Vibes, Matches, Private Cam) are optional and subject to all other provisions of these Terms. You agree to use these features honestly, to represent yourself accurately, and to respect other users' choices including blocks, declines, and match removals. ShinDig is not responsible for interactions between users that occur outside the platform.

7. Privacy

Our Privacy Policy describes how we collect, use, and share your information. By using ShinDig, you agree to our Privacy Policy.

8. Termination

We may suspend or terminate your account at any time, with or without notice, for violations of these Terms, our Acceptable Use Policy, or for any other reason at our discretion. You may delete your account at any time by contacting us at shindigsupport@gmail.com. Termination does not entitle you to a refund of any prepaid subscription fees.

9. Disclaimers

ShinDig is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• ShinDig will be uninterrupted, error-free, or available at any particular time
• Any content posted by users is accurate, complete, or appropriate
• ShinDig is free of viruses or other harmful components

ShinDig is a platform that connects users — we are not responsible for the conduct of users on or off the platform.

10. Limitation of Liability

To the maximum extent permitted by applicable law, ShinDig and Andre Martin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of ShinDig, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of these Terms or your use of ShinDig shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the courts of Florida, and you consent to personal jurisdiction there.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version here with a new "last updated" date. Continued use of ShinDig after changes are posted constitutes your acceptance of the updated Terms.
